Guidelines for
Bed and Breakfast Establishments
Development Control Plan No. 11
3.0 Making
an Application
3.1 Applications and Certificates
Bed and Breakfast Establishments are defined as Local
Development (whether or not also referred to as Integrated
Local Development by virtue of the location of the site),
under the provisions of the Environmental Planning and
Assessment Act 1979. A development application is required
to be lodged for approval with Council to operate a
Bed and Breakfast Establishment. The application should
include details of any internal or external renovations
or extensions required to facilitate the proposal.
Following the issue of development consent, it will
be necessary to obtain the following:
- a Construction Certificate - prior to commencement
of the necessary construction work. This is to confirm
the development will comply with the Building Code
of Australia 1996;
- A Compliance Certificate - to certify that
building inspections of construction works have been
satisfactorily completed; and
- An Occupation Certificate - required prior
to occupying the completed building.
These Certificates can be provided by Private Certifiers
or by Council under the provisions of the Environmental
Planning and Assessment Act 1979. Council provides an
efficient and competitively priced service in this regard.
Details of fees, application procedures and requirements
are available upon enquiry to Council's Customer Service
Unit.
3.2 Information Required
with a Development Application
The development application must include the following:
- a site analysis plan of the subject land and
adjoining sites, detailing the slope and aspect,
the location of all trees, buildings, provision for
off-street carparking and access, private recreation
areas, etc.;
- a floor plan of the dwelling-house clearly
identifying which parts of the dwelling will be used
for the Bed and Breakfast accommodation and facilities
and which parts for the permanent residents;
- elevation details of the dwelling-house;
- a landscape plan in accordance with Category
2 of Council's Landscape Policy L1;
- details of the effluent disposal system;
- details of any proposed sign, including dimensions,
content, style and colour scheme; and
- a comprehensive statement of environmental
effects, detailing the operation proposed, its
likely environmental effects and measures proposed
to mitigate any likely effects identified.
3.3 Contributions
Contributions toward the provision
of amenities and services (excepting Open Space and
Community Facilities contributions) will be levied where
applicable to Bed and Breakfast Establishments under
s.94 of the Environmental Planning and Assessment Act
1979 and the Water Supply Authorities Act, 1987, in
accordance with Council's Contributions Manual.
3.4 Variations
Each application will be considered
on the merits of the case and in terms of achieving
the objectives of this Development Control Plan.
Council may permit a variation to the standards contained
in this plan, only where special circumstances exist
and appropriate justification is provided. Any variation
must still satisfy the aims and objectives of this plan.
3.5 Public Notification/Advertising
Council will notify applications
for Bed and Breakfast Establishments in accordance with
the provisions relating to Local Development applications
within it's Development
Control Plan No. 70 - Notification of Development Proposals.
3.6 Registration
Operators of Bed and Breakfast establishments are encouraged
to register with the NSW Bed and Breakfast Council and
the Central Coast Tourism Board. Benefits include regular
newsletters, information packages, promotional opportunities
and contact with other Bed and Breakfast Operators in
the industry and other tourism services on the Central
Coast.
The owner(s) or proprietor(s) of the Bed and Breakfast
Establishment must keep a register and record the following
details with regard to every guest:
- names and addresses; and
- dates of arrival and departure.
A standardised format for the register is attached
to this Policy. This register must be maintained in
a legible fashion and be available for inspection by
an authorised officer of Council during normal office
hours.
3.7 Further Advice and/or
Information
Council's staff are always willing to help prospective
applicants, concerned neighbours or persons with questions
concerning the development process.

3.8 Review of this Plan
Council is committed to reviewing
the provisions of this plan as necessary to ensure that
the plan is relevant to the needs of visitors and residents,
and promotes the enhancement of the natural environment
and amenity of the Shire.
