Appendix A - Relevant Legislation, Planning Instruments and Policies

Federal Government Legislation
Environmental Protection and Biodiversity Conservation Act, 1999 - Identifies matters of world heritage value, ecological character of RAMSAR wetlands, nationally listed threatened species and communities, migrating species protected by international agreements and environmental assessment requirements for Commonwealth Marine environments.

NSW Government Legislation
In addition to the requirements of the Environmental Planning and Assessment Act, 1979 other legislation is relevant to the development of land containing natural assets and may require licences or other approvals in addition to a development consent from Council. Applicants should consult with relevant agencies prior to lodgement of a DA in relation to the following legislation:

Act Definition
Threatened Species Conservation Act, 1995 (National Parks and Wildlife Service)

Identifies threatened species, populations, ecological communities and critical habitat and sets requirements in the assessment of development proposals.

Native Vegetation Conservation Act, 1997
(Department of Land and Water Conservation)

Aims to improve the management of native vegetation. Consent from the DLWC is required for clearing native vegetation and for clearing Protected Land, although some exemptions exist for minor clearing.

Rivers and Foreshores Improvement Act, 1948 (Department of land and Water Conservation) Part 3A requires a permit from the Department for any excavation, removal of material or any works which obstruct or detrimentally affects the flow of waters within 40 metres of a river or lake.
National Parks and Wildlife Act, 1974 (National Parks and Wildlife Service) requires a permit to remove, damage, destroy or otherwise alter protected species or Aboriginal sites.
Protection of the Environment Operations Act, 1998 (Environment Protection Authority) Provides for comprehensive control over polluting activities and includes air, water, noise and land pollution.
Heritage Act, 1977
(NSW Heritage Office)
Controls development which may impact on identified heritage items by requiring the consent of the NSW Heritage Office.
Fisheries Management Act, 1994 (NSW Fisheries) Includes provisions similar to the Threatened Species Conservation Act in relation to the protection of aquatic species.
Water Management Act, 2000 Provides for the sustainable and integrated management of water resources.
State Environmental Planning Policies (SEPPS)
SEPP 14 Coastal Wetlands.
SEPP 26 Littoral Rainforests.
SEPP 44 Koala Habitat Protection.

Appendix B - Interim Conservation Areas for Wyong Shire

Appendix C - Regional vegetation types potentially occurring in Wyong LGA which were described and mapped by the regional vegetation mapping study which was supervised by LHCCREMS which may qualify under commonwealth and state criteria to be classified as an endangered or vulnerable plant community

The plant communities which are outlined below have experienced dramatic historic range and habitat area reductions and may qualify under Commonwealth and State Criteria as an Endangered or Vulnerable Plant Community. These plant communities are described in the report titled Vegetation Survey, Classification and Mapping in Lower Hunter and Central Coast Region.

*Indicates that these vegetation types may already be regarded as components of the Sydney Coastal Estuarine Swamp Forest Complex (SCESF) and Sydney Freshwater Wetlands in the Sydney Basin Bioregion (SFWSBB) have recently been listed as an Endangered Ecological Community under the Threatened Species Conservation Act, 1995.
