Access to Information

General guidance about obtaining information from Council can be found in the DOC format Access to information policy (63.50 KB) and doc format publication guide (558.50 KB).

The Policy explains the access to information structure and general principles Council has in dealing with information requests from the public. The Publication Guide outlines Council's structure and functions, methods of public participation in Council's affairs and the type of information Council holds.

Government Information (Public Access) Act 2009

Council holds a range of information. Access to that information is regulated mainly by the Government Information (Public Access) Act 2009 (GIPA Act). The GIPA Act provides a four pronged regime for accessing information from all NSW government agencies, including Council:

Mandatory proactive release:

It is mandatory for Council to make certain information called 'open access information' publicly available. This includes information about Council's policies and procedures; and also information about development applications, local approvals and orders. See: Public (Open Access) Information.

Authorised proactive release:

The GIPA Act authorises Council to proactively release information where there is no overriding public interest against doing so.

Informal applications:

The GIPA Act allows members of the public to apply for information informally. Council is able to release information requested informally and if appropriate, subject to reasonable conditions, provided there is no overriding public interest against release of the information. Formal access applications:

The GIPA Act allows members of the public to apply for information formally. Council is required to make formal decisions on these applications. These decisions can be appealed internally, or externally to the Information Commissioner and/or to the Administrative Decisions Tribunal. See: Informal and formal access applications.

Personal and health information

The Privacy & Personal Information Protection Act 1998; and the Health Records and Information Privacy Act 2002 both entitle a member of the public to apply for access to personal and health information held about them from Council.

Do you want access to general Council information, such as Council’s policies, procedures, registers, business papers & minutes?

General information about Council is public information under the GIPA Act.

Look at Council’s website, or view Council’s Publication Guide.

Do you want access to your personal information? For example, a copy of any correspondence you have sent to Council, details of any Service Requests you have lodged with Council.

You have a right of access to your personal information under the Privacy Act.

Send your request in writing to the attention of the Public Officer.

Do you want access to information about development approvals for a property, including building certificates and final inspection details?

Information about development applications; and other property information is generally public information under the GIPA Act.

Submit a Public (Open Access) Application and Informal Application Form.

Do you want access to other information held by Council?

You will need to apply for this information in accordance with either the informal or formal provisions of the GIPA Act.

Submit your informal request in writing to the attention of the Public Officer, or submit a Formal Access application form.

Informal and formal access applications

Informal and formal applications are generally for information that is not public information or your own personal information.

In deciding which type of application to make; the following important points should be remembered:

  • Council is not required to respond to an informal request for information, but will endeavour to do so nonetheless.   
  • Council is able to give information in response to an informal request; subject to reasonable conditions, such as restrictions on use of the information.   
  • There are no review rights for decisions on informal applications.   
  • Consultation with third parties affected by the information requested; either in regard to an informal or formal application may be required.   
  • Fees & Charges are applicable for formal applications.

Further information about informal and formal applications is available from the Information and Privacy Commission NSW website. Alternatively, Council’s Public Officer can provide guidance about which application is appropriate for the information being requested.

Application forms

If your request for information mainly relates to a property; and the information is not already available on Council's website via the Online Services facility, use the Informal Request. If your request for information is not for public information or your own personal information, use the Formal Access Application under the Government Information.

Council's Public Officer can provide further guidance on which application form to use.

Fees, Charges and Further Information

Generally, inspection of documents held by Council is free of charge. Where a copy of any document is required, reasonable copying charges will apply in accordance with Council’s adopted Management Plan.

Formal Access Applications concerning the personal affairs of the applicant attract a $30 application fee which covers up to 20 hours of processing time. Formal Access Applications for other types of information under the Government Information (Public Access) Act 2009 is charged at $30 per hour.
